Is it illegal to copy or recreate a design printed on a tshirt, and use it as album art for a CD? Please reply?

I am wanting to create a few album art CD covers for a music group I work with, but am wanting to know if it is illegal to copy or partly copy and redesign a logo/design which is printed on a t-shirt or piece of clothing. If I copied the design on the t-shirt onto paper either by freehand or tracing, and recreated it, to my liking, would this be okay?

If you didn’t create the original tee shirt design and then used it as you described, then you would be stealing that other designer’s creative property.

One can say that, if you “changed it enough” then it would be okay to use, but where that point is can be pretty tricky. For example, if the original image can still be recognized in your modified copy, you could still be sued by the copyright owner. On the other hand, if you modified the design to be completely unrecognizable from the original, then what would be the point of working from a copy?
